Executive summary/Whakarāpopototanga
Two late submissions were received on council’s 2021 Representation Review Initial Proposal after the close of time for submissions: being 4pm Friday 10 September. One of the late submitters has also indicated he wishes to be heard.
The staff recommendation is that council formally receives the late submissions, on the grounds that this will not impact on the process and there is no legal impediment to receiving a late submission.
It must be noted at the 28 July 2021 council meeting when the Initial Proposal was adopted and submitted for formal consultation, council resolved the following:
Due to the tight legislative timeframes of the Representation Arrangements Review, late submissions will not be accepted.Therefore, if council accepts the late submissions it is technically rescinding a previous decision of council. As per Standing Order 24.6.
24.6 Revocation or alteration by recommendation in report
The local authority, on a recommendation in a report by the Chairperson, Chief Executive, or any committee or subcommittee, may revoke or alter all or part of a resolution passed by a previous meeting. The Chief Executive must give at least two clear working days’ notice of any meeting that will consider a revocation or alteration recommendation.

It should also be noted that if council accepts the late submissions then in accordance with Section 19M of the Local Electoral Act (LEA), any person who makes a submission is given reasonable opportunity to be heard (if that person so requests) and in accordance with section 19N of the LEA, council must consider all submissions received.
1. That the report ‘Receipt of Late Submissions’ by Chris Taylor, Governance Specialist and dated 16 September 2021, be received.
2. That the late submissions received from Mr Brett Collins and Mr SK Reilly be accepted and in accordance with Section 19M of the Local Electoral Act Mr Brett Collins’ request to be heard is approved.
